1. Join A League Agreement
This Join A League Agreement is for the hire of venues and facilities between company trading as ‘Match Night Leagues’ (We, or Us) and the following ‘team’ (the “Team”, You). These Conditions do not affect your statutory rights.
League and playing rules are available separately under the ’The League Rules’
1.1 When a team signs up to ‘Match Night Leagues’ you join by the Join A League page on website completing all sections of terms & conditions and disclaimers on behalf of all players in their ‘team’. Interest can be registered by website, phone, or social media.
1.2 On behalf of your ‘Team’ You agree to a minimum of 1 full season or 10 weeks pitch hire at the appropriate venue and is a binding agreement under which the ‘Match Fee’ is payable weekly whether the team attends matches or not.
1.3 Only payment in full is accepted by Match Night Leagues at the start of each game. There can be no part payments or money owed to Match Night Leagues at any point of your agreement.
1.4 Match Night Leagues will automatically enter you into a further 10 week hire agreement towards the expiry of the season. If your ‘Team’ does not wish to enter that agreement, ‘Team Captain’ must provide a minimum of 2 week’s notice, Otherwise Match Night Leagues will assume you wish to enter a further agreement.
1.5 This hire agreement is in respect the same activity at the same location of the ‘Team Sign Up’ Agreement moving venues mid-series will not be permitted.
1.6 Each session is for 30 minutes. During your match your ‘Team’ will have exclusive use of the pitch vs opponent.
1.7 All players within the Team agree to abide by the ‘League Rules’ as published on the website and sent to the nominated captain upon team Join A League entry form and from time to time.
1.8 Match Night Leagues and representatives of Match Night Leagues reserve the right to refuse entry of any Player, Team, associate of Team or Organisation from facility of hire or any and all of Match Night Leagues without giving a reason. Match Night Leagues reserve the right to exclude any Player Team, or Organisation from its competition for breaches of these terms or of the ‘League Rules’ or in respect of any misconduct whatsoever by its Team, Players, or associates of the Team.
2.1 The ‘Match Fee’ is payable in cash per week and Match Night Leagues reserve the right to increase Match Fees with 6 days notice at any time during the season. The Match Fee is payable to the referee before the Match commences in full, without any monies owing to Match Night Leagues but on request this may will be collected from your Team by a Match Night Leagues representative to not interrupt any fixtures. The Team Captain is responsible for the Match Fee,
2.2 Match Night Leagues operate a zero tolerance for or part payments. If the full ‘Match Fee’ is not received before the game, for any reason, the Team will not be able to play and will owe the full amount the next week. Any monies the Team is in credit the full Match Fee will be deducted from this stated figure.
2.3 If a Team is issued with ‘No Pay – No Play’ , the Team will forfeit the fixture and the opposing Team will be awarded to a 5-0 default win.
2.4 Failure to pay Match Fees shall be deemed a breach of League rules and Match Night Leagues reserve the right to remove the Team from that League.
2.5 The Team captain is responsible for all Team payments including team fines and Match Fees. Any monies owed must be paid before the commencing of next fixture in full before playing.
2.6 Any team that leaves any of Match Night Leagues with arrears, the Team will be banned from any Match Night Leagues until monies owed are paid in full by bank transfer, cheque or cash direct to Match Night Leagues. The Team Players may not join another team, play for any other team or form team in another name until all monies owed to match Night Leagues are paid in full.
2.7 Match Night Leagues reserve the right to withhold any trophies or medals from Teams that have monies owing from debt accrued at any point of the associated season.
3. Non Attendances or ‘Stand Downs’
3.1 If a Team is absent for a fixture without giving providing 7 days notice the opposition shall be awarded the game as a 5-0 result.
3.2 If a Team gives proper notice, it is agreed that the Match Fee for that fixture will not be chargeable. Proper notice requires the Team Captain or Team representative to
notify us by phone call or email. This goodwill gesture reflects the benefits to Match Night Leagues of being informed of absences in
advance. Failure to provide proper notice will result in payment of full Match Fee before the next weeks fixture.
3.3 The opposing team to an absent teams Match Fee will be compensated and reduced to the amount of up to 50% with the opposing team still fulfilling a fixture as a challenge Match.
4. Teams Providing Notice to leave Match Night Leagues:
4.1 A Team can only leave the current league at the end of the season.
4.2 To not be automatically included in a new season the Team captain must give at least 2 weeks’ notice before the end of the current season
4.3 The Team must then fulfil the remainder of that season’s fixtures, and shall be withdrawn before the new season commences.
4.4 The Club can only withdraw via phone on 07498395901 or via www.matchnightleagues.co.uk This is so that the final position can be discussed and agreed.
4.4 Any team that leaves any of Match Night Leagues with arrears the Team will be banned from any Match Night Leagues until monies owed are paid in full by bank transfer, cheque or cash direct to Match Night Leagues. The Team Players may not join another team, play for any other team or form team in another name until all monies owed to match Night Leagues are paid in full.
4.7 The Team Captain consents that if outstanding monies including Match Fees and Fines, but not limited to, for the Team remain unpaid fourteen days after leaving the league by cash, cheque, or bank transfer. Match Night Leagues have permission to collect any monies owing from the credit card details held on file from previous transactions with Match Night Leagues.
4.8 If a Team leaves the league following the correct procedures as stated above, any monies owed to the Team made as overpayments will be returned via bank transfer to the Team Captain only.
5. Health & Safety
5.1 All Players understand that by Team Captain completing ‘Team Sign Up’ you are entering a small sided football league, is a contact sport and contains an element of risk to the person participating.
5.2 Match Night Leagues take care to select suitable and safe venues and able and competent referees. All players agree and understand that Match Night Leagues do not own or have exclusive occupation of facilities and have little or no control in respect of persons admitted to premises (including adjacent sports pitches and surrounding perimeters) during matches and have little or no control as to how premises are used and left before and / or after matches.
5.3 Team Captains are responsible for ensuring that they do not allow their Teams players to commence a game until and unless satisfied that the surface and other conditions are safe for the match whilst having due regard to the characteristics of their team players.
5.4 Players must report to Match Night Leagues immediately any perceived dangers, violence (or threats of the same), or any other misconduct of whatever type.
5.5 Players must report and near misses or accidents whilst ‘competing’ within 5 days of accident. Any accidents when teams/player are not competing must be directed to facility as Match Night Leagues are not responsibility for any facility only the hire of area for Match Night Leagues to facilitate small sided football leagues.
5.6 Match Night Leagues have associated risk assessments available as a pdf document on request by team captain and must not be changed or reproduced at any point.
5.7 Match Night Leagues obtain appropriate public liability, professional indemnity and employers liability insurances via Protectivty Insurances and policy numbers can be requested by team captain.
5.8 By signing up to a Match Night League the Team Captains is responsible for all players and must ensure all players are aware of the ‘player vs player’ exclusion. It is recommended all Players gain their own personal insurance before Playing at Match Night Leagues.
6. Liability / Breaches of contract
6.1 Match Night Leagues shall provide its services with reasonable skill, competency, care and to a satisfactory standard.
6.2 Match Night Leagues is in breach of the agreement and the breach is capable of remedy, Match Night Leagues will use its very best efforts to provide a solution mutually acceptable to Match Night Leagues and the Team / Player. Match Night Leagues Directors decision is final.
6.3 Notwithstanding the above, in the event of Match Night Leagues.
6.3.1 breaching the agreement or committing any tort, including the negligence or negligent misstatement of its servant or agents; and / or
6.3.2 being in any breach of any statutory or common law duty of care will have no liability to Players save that Match Night Leagues will indemnify the Players in respect of any death or personal injury caused thereby and in respect of which no limitation or exclusion is intended;
6.4 Match Night Leagues shall not be liable for:
6.4.1 any damage to property/facility whether arising directly or indirectly from any breach or player attending a Match Night Leagues fixture.
6.4.2 loss of income, or profit, revenue, goodwill or anticipated savings whether arising directly or indirectly from any breach.
6.4.3 loss or damage of player valuables and/or facility but not limited to:
6.4.4 any indemnity in respect of the items listed directly above.
6.5 The liability of Match Night Leagues for all the losses caused by a breach giving rise to a claim shall be limited to damages of twice the total amount paid by the Players to Match Night Leagues pursuant to the matches in respect of which the breach shall occur, and which both Match Night Leagues and the Player(s) have considered and agree is a reasonable sum given the respective positions of the parties and the types of direct losses likely to occur.
7.1 Match Night Leagues may subcontract any area of business under this agreement to any person without notice. Where Match Night Leagues subcontract its area of business under this agreement Match Night Leagues shall not be responsible for every act or omission of the sub-contractor. It is expected all sub-contractors will hold acceptable levels of competency and insurance.
7.2 Match Night Leagues may assign this Agreement to any person within your Team at any point.
7.3 Match Night Leagues shall not be liable for any loss or damage caused by delay in the performance or non-performance of any areas of business where the same is occasioned by any cause whatsoever that is beyond The Match Night Leagues reasonable control including but not limited to an Act of God, terrorism, war, civil disturbance, un-preventable flood, failure or neglect on the part of any utility supplying electricity, gas or water, the unavailability of or the prevention of access to premises, governmental regulations, prohibitions or enactments of any kind, strike, lock-out or trade dispute (whether involving its own employees or those or any other person), difficulties in obtaining staff or materials, breakdown of machinery, fire or accident or loss of premises. Should any such event occur Match Night Leagues may cancel or suspend the Agreement without incurring any liability for any loss or damages thereby occasioned.
7.4 This contract shall be governed by English Law and shall be subject to the sole jurisdiction of the English Courts.
